Service Agreement

This Service Agreement ("Agreement") governs your use of all the games we publish in Tiktok (the "Game"), a mini-game available on the TikTok platform. The Game is operated by Hangzhou Ｍakeinu Cultural communication Co.Ltd. ("we," "us," or "our"), located at 221JianTang Road ，HongZhou, ZheJiang, 310000, China. By downloading, accessing, or using the Game, you agree to be bound by this Agreement. If you do not agree to this Agreement, please do not use the Game.

1. ELIGIBILITY AND ACCOUNT REGISTRATION

1.1 Age Requirements: You must be at least 13 years old to use the Game. If you are between 13 and the age of majority in your country of residence, you represent that your legal guardian has reviewed and agreed to this Agreement on your behalf.

1.2 TikTok Account: The Game is accessed through your TikTok account. By using the Game, you authorize us to access certain TikTok account information, including your username, profile picture, and user ID, to provide the Game services.

1.3 Accuracy of Information: You represent that all information you provide in connection with the Game is accurate, current, and complete.

2. LICENSE AND ACCESS

2.1 Grant of License: Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Game for personal, non-commercial entertainment purposes.

2.2 License Restrictions: You agree not to: copy, modify, or create derivative works; reverse engineer or extract the source code; use the Game commercially without our written consent; use cheats, bots, or unauthorized third-party tools; interfere with Game servers; or violate applicable laws.

3. INTELLECTUAL PROPERTY RIGHTS

3.1 Ownership: The Game, including all content, graphics, interface, audio, video, and code, is owned by us or our licensors and protected by intellectual property laws worldwide. All rights not expressly granted are reserved.

3.2 User Content: If you submit content (e.g., scores or comments), you retain ownership. However, you grant us a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, and display such content solely to operate and improve the Game.

4. USER CONDUCT

4.1 Prohibited Conduct: You agree not to use the Game to: harass or harm others; impersonate any person; post defamatory, obscene, or offensive content; or violate applicable laws.

4.2 Enforcement: We reserve the right to investigate and take appropriate legal action against violators, including suspending or terminating your access.

5. IN-GAME PURCHASES AND VIRTUAL CURRENCY

5.1 Purchases: In-game purchases of virtual items or currency ("Virtual Items") are final, non-refundable, and non-transferable except as required by applicable law.

5.2 Pricing: Prices for Virtual Items may vary by region. We reserve the right to modify prices at any time.

5.3 No Real-World Value: Virtual Items have no real-world monetary value and cannot be exchanged for cash or other items outside the Game.

5.4 Subscription Services: Subscription terms (including billing frequency and cancellation) will be disclosed at purchase. You may cancel through your TikTok account settings or the applicable app store.

6. PRIVACY AND DATA PROTECTION

6.1 Privacy Policy: Your use of the Game is subject to our Privacy Policy, which is incorporated into this Agreement. It explains how we collect, use, and share your personal information.

6.2 Compliance with Laws: We process your personal information in accordance with applicable data protection laws.

6.3 Data Processing: By using the Game, you consent to the processing of your personal information as described in the Privacy Policy. You may withdraw consent at any time, but this may affect your ability to use certain features.

6.4 Cross-Border Data Transfers: Your information may be transferred to and processed in other countries. We ensure appropriate safeguards for such transfers in compliance with applicable laws.

7. THIRD-PARTY SERVICES

7.1 Third-Party SDKs: The Game integrates third-party SDKs for analytics, advertising, and functionality. These third parties may collect information as described in our Privacy Policy.

7.2 TikTok Platform: Your use of the Game is also subject to TikTok's Terms of Service and Privacy Policy.

7.3 App Stores: If downloaded through an app store, your use is also subject to that store's terms.

7.4 No Endorsement: We are not responsible for and do not endorse any third-party websites, products, or services linked to or from the Game.

8. ADVERTISING

8.1 Third-Party Ads: The Game may display advertisements from third-party networks. These ads may be personalized based on your interests and usage patterns.

8.2 Opt-Out Options: You may limit personalized advertising through your device settings. You may also have rights to object to processing for direct marketing purposes under applicable laws.

8.3 Children: If we have actual knowledge that a user is under 13, we will not serve personalized advertising to that user.

9. TERMINATION

9.1 Termination by You: You may stop using the Game at any time. To delete your account and associated data, please contact us at support@haiken-culture.cn.

9.2 Termination by Us: We may suspend or terminate your access to the Game at any time, with or without notice, for any reason, including if we believe you have violated this Agreement.

9.3 Effect of Termination: Upon termination, your license ends, and we may delete your account and associated data. Sections that by their nature should survive termination will survive.

10. DISCLAIMER OF WARRANTIES

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE GAME, THIRD-PARTY CONDUCT OR CONTENT, OR UNAUTHORIZED ACCESS TO YOUR TRANSMISSIONS. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100) OR THE EQUIVALENT IN YOUR LOCAL CURRENCY. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Game, your violation of this Agreement or any third-party right, or any content you submit.

13. DISPUTE RESOLUTION

13.1 Governing Law: This Agreement shall be governed by the laws of [Your Home Country/State], without regard to its conflict of laws principles. However, local consumer protection laws that cannot be waived by contract shall apply to users in their respective jurisdictions.

13.2 Informal Resolution: Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at support@haiken-culture.cn. We will attempt to resolve the dispute within 60 days.

14. CHANGES TO THIS AGREEMENT

We may modify this Agreement from time to time. If we make material changes, we will notify you through the Game or by other means. Your continued use of the Game after the changes become effective constitutes your acceptance of the revised Agreement. If you do not agree to the changes, you must stop using the Game.

15. GENERAL PROVISIONS

15.1 Entire Agreement: This Agreement, together with the Privacy Policy and any other documents incorporated by reference, constitutes the entire agreement between you and us regarding the Game.

15.2 Severability: If any provision of this Agreement is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

15.3 Waiver: Our failure to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision.

15.4 Assignment: We may assign this Agreement, in whole or in part, at any time without notice to you. You may not assign this Agreement or transfer any rights to use the Game.

15.5 Force Majeure: We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control.
